اقرار ازحیث توان اثباتی در میان ادله نقش تعیین کننده دارد وآنچه جایگاه ویژه اقرار را در نظام حقوقی معین می کند وآن را در زمره اعمال یا وقایع حقوقی قرار می دهد ماهیت اقرار است. اقرار در ماده۱۲۵۹ ق.م ص‌اخبار به حق‌تعریف شده که وصف اخباری دارد ومقر از وجود رویداد وحقی خبر می دهد که می تواند متصف به صدق یا کذب باشد.انکار نیز مانند اقرار متصف به صدق وکذب بوده ونوعی اخبار می باشد .در برخی موارد مقصود متکلم ناظر بر معنای حقیقی اقرار و انکار نبوده و به استناد قراینی مقصود از افاده‌ی آن الفاظ، انشای عمل حقوقی می‌باشد .بااین وجود صحت و انشایی بودن چنین استعمالی محل بحث و بررسی می‌باشد که در پژوهش حاضر بدین مهم پرداخته می‌شود .نگارش پژوهش حاضر به روش نظری، به صورت تحلیلی بوده و چنین نتیجه‌گیری می‌شود که از آنجایی که در حقوق ما قصد باطنی بر معنای حاصل از ظاهر الفاظ حاکم می باشد چنین اقرار و انکاری صحیح و انشایی بوده و موجد اثر حقوقی است

Confession in terms of the affirmation capability among the reasons are decisive, and what determines the special place of confession in the legal system and places it within the scope of legal acts or events is the nature of the confession. According to Article 1259 of civil law, confession is described as rightful assertion, which has a news item and the item notifies the existence of an event that can be truthful or false. Denial, like the confession, is truthful and false, and is a kind of assertion. In some cases, intention of the speaker is not to observe true meanings of confession and denial, and intention of using such words is for creation of a acte juridiques. However, the veracity and exuberance of such an apostate is the subject of discussion, which is discussed in this study. The presented research is based on a theoretical, analytical, and is concluded that iranian law our real intentions of the meaning of a rules word over its Apparent meaning: Such a confession and denial are true and creational to the legal effect
