.The using prevalence of the Bank Guarantees in the realm of the domestic trade to guarantee the commitments, particularly in the construction contract, reveals more and more the necessity of its studying. Nevertheless in our law there is no consistent regulation about Bank Guarantees except some directive regulation. And this poverty law about important guarantee in the realm of the domestic trade creates some problems. Therefore the legislator in the course to remedy thisshortcomingandprovidea legal frameworkin compliance withthe principles governingin this commercial document in Thenewbill Commercial Code, allocated the separate chapter to that, which thisappreciatedthat thelegislatorinitiated,needs to study its current trends.In this thesis with conception of importance of this guarantee and its trends in the future, we tried to study the regulation about guarantee both in banks practical procedure and the new Bill of Commercial Law. Of course finding the guarantees effects and qualifications needs to scrutining studying about nature of this banks document which with placing that in the specified format could get more information about that. With our studying in this thesis seems the best analysis about Bank guarantees is to place them in the format of Art 10 of the Civil Code
